Stark Dismisses Bushart Case

Paducah, KY – Graves County Circuit Judge Tim Stark dismissed a three-year-old reckless homicide case Tuesday. He cited a newer Kentucky law that presumes Michael Bushart fatally shot Michael Clapp in self-defense. Bushart was an overnight guest at a home in Wingo when Clapp broke in. The law went into effect just half-a-year before the shooting and assumes anyone who breaks into a home intends to commit an unlawful action involving force or violence. The Paducah Sun reports Commonwealth Attorney David Hargrove will review the case to decide whether or not to appeal Stark's ruling.
