Judge To Hear Argument over Kentucky Execution Protocol

Frankfort, KY – A Kentucky judge is set to hear arguments today over whether to stop executions in the state, including one scheduled next week. Franklin Circuit Judge Phillip Shepherd will focus on whether an injunction handed down in November by the Kentucky Supreme Court halting all executions in the state is still in effect. The high court ruled that the Commonwealth failed to properly adopt a three-drug lethal injection protocol, which was re-implemented last May. Governor Steve Beshear set an execution date next week for Gregory Wilson, condemned to death for a 1987 kidnapping, rape and murder. An attorney for multiple death row inmates says because no court has dissolved the injunction, it remains in effect and executions are prohibited. State attorneys argue the protocol's re-adoption ended the injunction because the state complied with the court's order.
