Governor Andy Beshear was being sued by former state school board members he ousted through an executive order on Tuesday, in an effort by Beshear to reorganize the board. Now, a Franklin County Circuit Court Judge is denying an injunction to halt the reorganization.
WKYT reports the former Kentucky Board of Education members in a lawsuit say the reorganization was outside Beshear's authority and that members could only be removed "for cause." Judge Thomas Wingate disagreed, saying the reorganization is within "the ambit of the Governor’s temporary-reorganization-outside-of-session power…”
The new Democratic governor wielded his executive authority Tuesday to reorganize the Kentucky Board of Education with 11 new members. The new board appointed by Beshear has scheduled a special meeting for Thursday.
