Commonwealth Attorney Offers Deal to Newberry and Harnice in Zoning Misconduct Case

McCracken County Judge Executive Van Newberry and deputy judge Doug Harnice were offered a deal by the Commonwealth in Circuit Court Friday.

Special prosecutor G.L. Ovey would not elaborate on the details of the offer. 

Ovey told Circuit Judge Dennis Foust that the two sides agreed that 30 days is a reasonable timeframe to consider the possible agreement.

“The July 2 date is a deadline date,” Ovey said. “The offer is either going to be accepted or it will be rejected or I’ll withdraw the offer and it will not be extended again and we will go to trial.”

A trial date has been scheduled for January 6 in case the defense does not agree to the offer. Newberry and Harnice are charged with tampering with public records in connection with unauthorized zoning changes.

Newberry has continued to express their innocence of the charges.
