Kentucky – A Frankfort judge has upheld regulations that allow betting on rebroadcasts of old races at Kentucky horse tracks. The Kentucky Horse Racing Commission approved the Instant Racing regulations in July to give the industry a financial boost. The idea has drawn opposition from anti-gambling groups like the Family Foundation. Martin Cothran contends Instant Racing wagering is not the same as pari-mutuel betting allowed under Kentucky law.
"These instant racing machines have bettors wagering on videos of past horse races. And what Kentucky law allows for is there be pari-mutuel wagering on actual horse races. But a video of an old horse race is not an actual horse race."
Cothran says the Family Foundation will appeal the ruling.
