Frankfort, KY – "Drugged driving" legislation once again appears headed for state senate approval. Its chances in the house remain a question mark. The per se' measure unanimously passed out of the senate judiciary committee this week. Sponsor Ray Jones says, if enacted, it would provide a better chance of blood test testimony being heard in court. Meanwhile, House judiciary committee chair John Tilley has concerns.
"We are prosecuting drivers who are intoxicated on drugs this would hopefully strengthen that but at the same time it has some legal problems so I just try to look through those."
Tilley contends blood tests don't always determine impairment at the time of car crashes. Jones says drugged driving cases have increased significantly over the past several years.
