Franklin Circuit Court Judge Phillip Shepherd is expected to make a decision soon in the lawsuit over the closure of Graves County's Cuba Elementary School.
In April, a group of residents sued the Graves County School Board for allegedly using improper procedures when changing its District Facilities Plan prior to closing the school. The district was set to sell the school as surplus property on June 18th before the court issued an injunction stopping the auction to allow for the court's decision.
Board Attorney David Hargrove says Friday was the last day for either side to enter arguments or evidence.
“There are no new or further court dates scheduled after September the 12th," said Hargrove. "These types of summary judgment motion are where typically you have the arguments that we need. The documents we needed to file have been filed by both sides, the arguments have already been made, and so now it’s up to the judge to simply make a decision.”
School officials voted to close the elementary school citing low enrollment which totaled less than 200 students, all of the students have been moved to Wingo and Sedalia elementary schools.
