Conway Challenges EPA Authority Over Carbon-Emission Regulations

Kentucky Attorney General's Office

Kentucky Attorney General Jack Conway is joining attorneys general in 11 other states in asking a federal appeals court to rule quickly in a lawsuit against the Environmental Protection Agency. The states are challenging the EPA's authority to regulate carbon emissions from coal fired power plants.

Conway spoke at a news conference in Ashland on Wednesday.

“The rules that have been proposed in my opinion are not only illegal but they fly in the face of traditional environmental regulation which is to allow the states to develop their own responses or how they deal with what’s required by the Clean Air Act,” said Conway.

In June, the EPA proposed a 30-percent reduction in carbon emissions from power plants by the year 2030.  A court motion urges an expedited ruling as states are already spending time and money to prepare for the new regulations, which the lawsuit seeks to throw out.
