Louisville, KY – A University of Louisville law professor says Elena Kagan will likely become the next U.S. Supreme Court justice. Brandeis School of Law professor Russell Weaver believes the Solicitor General, who was nominated to the Supreme Court today (Monday), should have an easy confirmation.
"She's eminently qualified, she's not as controversial. You look at Sotomayor, some of the comments she made raised some questions about her. But Kagan hasn't done anything like that. The only issue that's come up with her is the issue regarding the Solomon amendment, and I don't think that's going to be a major obstacle for her."
The Solomon Amendment was passed by Congress in 1986, requiring universities to give military recruiters the same access to campus that they give to other employers, or else lose their federal funding. Kagan signed a friend-of-the-court brief in 2005, asking the Supreme Court to cut back on the amendment. She was named the first female dean of Harvard Law School in 2003.
