Clarksville, TN – Both the city of Clarksville and its marina development contractor are downplaying the significance the project lacked flood insurance after the Cumberland River overtook the area earlier this month. The Clarksville Leaf Chronicle reports there are still differing accounts of what the contract requires. TMS Contracting president Thom Spigner supplied the newspaper with documents supporting his claim that flood insurance isn't a required coverage area. This contradicts prior reports. Attorney Roger Maness who represents the city says the insurance requirements defined in the bid specifications still apply and those require a catch-all' coverage policy, including flood insurance. Though, both parties agree dirt work wouldn't be covered by the policies. The city wants TMS to be financially responsible for the damage, which has still yet to be assessed.
