Clarksville, TN – The U.S. District Court of Appeals for the Sixth Circuit has upheld the murder conviction of a Clarksville man despite admonishing the prosecution about its practices during the trial. The Clarksville Leaf-Chronicle reports 51-year-old Donald Gene Brooks was convicted of first degree murder in the 1994 death of 39-year-old Joseph Wisniewski. Brooks later appealed his conviction, claiming the prosecution knowing permitted false testimony, recruited a jailhouse informant to gain a confession, and failed to disclose damaging material about the informant. The appellate court agreed with Brooks in their ruling but found that he was not entitled to legal relief.
