Washington D.C. – Two years after the Tennessee Valley Authority's huge coal ash spill at the Kingston plant, the U.S. Environmental Protection Agency says it still isn't sure when there will be a decision on whether to classify coal ash as hazardous. The agency held eight public hearings on proposed regulations and has received more than 200,000 comments. One proposal would regulate coal ash as hazardous waste under federal enforcement. The other would regulate it as a nonhazardous material, with enforcement handled through "citizen" lawsuits. The agency says it is unsure when regulations will be finalized.
