Judge Refuses to Dismiss Paul Volunteer Case

By Angela Hatton /Associated Press

Lexington, KY – A judge in Lexington has declined to dismiss a misdemeanor assault charge against a former Rand Paul volunteer. Tim Profitt is accused of kicking a liberal activist during the fall Senate race. Fayette County District Judge Kim Wilkie says he based his decision on a video of the incident that showed Profitt stepping on a MoveOn.org activist after an October Senate debate. The video was widely circulated on news stations. Profitt argued in a motion to dismiss the charge that he was justified in using force in order to protect Paul.
