Mayfield, KY – A Kentucky Court of Appeals ruling reinstates a reckless homicide case dismissed last year. Michael Bushart will again face charges in the fatal shooting of Michael Clapp at a home in Wingo four years ago. The case was the state's first where a judge applied new parameters of a law that bolsters a person's ability to claim self-defense during a home invasion. The Paducah Sun reports Graves Circuit Judge Tim Stark will again have to determine if Bushart was acting in self-defense when the shooting occurred, but this time without considering an affidavit Bushart filed with his version of what happened that wasn't included in police reports and interviews.
