Fort Campbell, KY – The former Fort Campbell soldier accused of double murder in Hardin County did not walk out of jail yesterday as expected.
Hardin Co. Commonwealth's Attorney Chris Shaw asked a judge to dismiss murder charges against Brent Burke, citing four mistrials. Under state law, family members must be properly consulted. The families of Tracy Burke and Karen Comer learned of Shaw's decision in a letter and they say he never returned their phone calls. They have hired Elizabethtown attorney Carey Aldridge. Prosecutor Shaw maintains he did consult the family and wants the case dismissed because he doesn't feel another jury could convict Burke unless new evidence is found. For now, Hardin Circuit Judge Kelly Mark Easton has delayed a decision on dismissing the case. Brent Burke was returned to jail where he has spent the past four years.
