Franklin, KY – The Kentucky Court of Appeals has ruled that Kentucky Downs in Franklin can continue operating its Instant Racing game. The game, which involves wagering on "historical races," started at Kentucky Downs on September 1. The Courier-Journal reports this is the second time the court declined to issue an injunction against the devices requested by the Family Foundation of Kentucky. The court says the foundation wouldn't be harmed enough to justify blocking the use of the machines.
