A Dollar General will be built along U.S. 45 south of Lone Oak after the McCracken County Fiscal Court passed a zoning change Monday night.
Highway 45 is a limited control access restricting access to the road every 1,200 feet.
“The issue here to me is, is the landowner," Wathen said. "It’s not really the planning and zoning, I mean the, the people that control the land determine who they can sell it to whether it be an individual or a business.”
The planning and zoning commission approved the change prior to the fiscal court looking into the issue. Residents of a nearby subdivision voiced their opposition to the court at an earlier meeting. Members of the board talked to those residents.
Judge-executive Bob Leeper said the fiscal court has an obligation to approve decisions by the planning and zoning commission as long as those changes are legal.
Commissioner Jerry Beyer was the only fiscal court member to vote no on the zoning change.
