Pretrial Conference Set in McCracken County Zoning Case

A pretrial conference is set in the zoning misconduct case involving the McCracken County Judge Executive and his Deputy.  

The attorney for Deputy Judge Executive Doug Harnice says the defense will meet with the prosecution before the judge on March 21 to determine the proceedings for the trial.  

Judge Executive Van Newberry and Harnice face felony charges of tampering with public records in connection with unauthorized zone changes affecting at least 500 pieces of property in McCracken County. 

Defense attorney David Bundrick says he is in the process of reviewing discovery from the Commonwealth’s Attorney G.L. Ovey, which includes police reports, witness statements and testimony from the jury.

The only court appearance Newberry and Harnice have made so far was arraignment at which Judge Craig Clymer recused himself citing an appearance of impropriety. Marshall County Circuit Judge Denis Foust stepped forward to oversee the case.

Bundrick says possible court dates will be discussed at the pretrial conference.
