A grand jury on Tuesday returned an indictment against a former Murray High School teacher and coach accused of setting up a video recording device in a school bathroom.
The grand jury's signed true bill was filed in the Calloway Circuit Court. Charges include 11 counts against 53-year-old Mark Boggess of Murray.
Three counts are Class D Felonies involving the possession and viewing of matter portraying a sexual performance by a minor. According to the document, the alleged offenses occurred between January 1, 2019 and April 25, 2019. The document said Boggess had knowledge of the content, character and sexual performance and "intentionally viewed matter which visually depicts an actual sexual performance by a minor person."
The other counts are Class A Misdemeanors involving voyeurism in the same time period. The charges say Boggess "intentionally used a camera for the purpose of videotaping the genitals, an undergarment worn without being publicly visible, or a nipple of the female breast of another person without that person's consent," in violation of the law.
According to the Calloway County Jail, Boggess was released on April 26 on a $25,000 cash bond. Among the conditions of release, Boggess cannot have contact with witnesses or alleged victims.
The arraignment is set for July 2.
